Terms & Conditions

1. Contract

These Terms and Conditions apply to all purchases made through Heymat’s online store at www.heymat.com (the “Website”).
The agreement between the customer (“Purchaser”) and Heymat AS (“Seller”) consists of these Terms and Conditions, the information provided in the checkout process, and any specific written agreements between the parties.

In case of a conflict, specifically agreed conditions shall take precedence, provided they do not contravene mandatory consumer protection laws.

All purchases are governed by Norwegian law, including the Consumer Purchases Act, the Marketing Control Act, the Cancellation Act, and the E-Commerce Act.

Heymat AS controls and operates the European website from offices in Norway.
Heymat INC controls and operates the U.S. website from offices in the United States.


3. Intellectual Property Rights

All content on the Website—including text, images, graphics, product designs, trademarks, and layout—is the property of Heymat AS or its licensors and is protected by copyright and other intellectual property laws.

You may not:

  • reproduce, copy, or redistribute any material from the Website,

  • use our trademarks or product designs without permission, or republish, sell, or commercially exploit any Website content.

Any unauthorized use of Heymat’s intellectual property will be subject to legal action.


4. Prices

The total price shown at checkout includes all costs related to the purchase, including taxes, fees, and shipping, for European customers. No additional costs will apply unless clearly stated before the order is completed.

For orders delivered to the USA, prices shown do not include applicable sales taxes. Any applicable taxes will be added at checkout.

Purchases can only be made in the currency available for the selected delivery country. Prices shown at checkout include the applicable VAT, sales tax, and duties where applicable, depending on the delivery country.


5. Formation of Contract

A purchase agreement is binding once the Purchaser has submitted an order through the Website and received an order confirmation from the Seller.

However, the Seller is not bound by the order if there are obvious typographical or pricing errors that the Purchaser should have recognized.


6. Payment

The Purchaser may pay using the payment methods available at checkout. The Seller may charge the Purchaser once the order has been confirmed and the goods are prepared for shipment.

Payment processing for purchases made on our Website is provided by Adyen N.V., a licensed payment institution supervised by the Dutch Central Bank (De Nederlandsche Bank). Adyen processes payments on behalf of the Seller and ensures a secure, PCI-DSS–compliant environment for all card and alternative payment methods.

When completing a purchase, the Purchaser enters into a payment agreement with the Seller (Heymat AS or Heymat INC, depending on the delivery country), while the transaction itself is securely handled by Adyen.

Accepted payment methods include:

  • Credit/debit cards (Visa, Mastercard, American Express)

  • Klarna Checkout (where available)

  • Mobile payments (Vipps, MobilePay)

  • PayPal (where available)

All card and payment information is encrypted and transmitted directly to Adyen. Heymat does not store or have access to full payment details, such as card numbers or authentication data.

For payment methods that allow post-delivery invoicing (e.g., Klarna), the invoice is issued when the goods are shipped. The due date will be at least 14 days after delivery. Purchasers under 18 years of age cannot pay by invoice.

If the Purchaser’s payment method cannot be charged, or if fraudulent activity is suspected, the Seller may cancel the order after notifying the Purchaser.


7. Delivery

Delivery is considered completed when the Purchaser or their representative has taken possession of the goods.

If no specific delivery time is stated at checkout, the Seller will deliver the goods within a reasonable timeframe, and no later than 30 days after the order is placed, unless otherwise agreed.

Goods are shipped to the delivery address provided by the Purchaser. Delivery terms, including shipping partners and estimated delivery times, are shown at checkout.


8. Product Risk

The risk of the goods passes to the Purchaser once the goods are received by the Purchaser or their representative.


9. Right to Cancel (Withdrawal Right)

Unless exempt under law, the Purchaser has the right to withdraw from the contract within 14 days of receiving the goods.

To exercise this right, the Purchaser must notify the Seller in writing (by email or letter) before the withdrawal period expires. The Purchaser bears the direct cost of returning the goods unless otherwise agreed.

Returned goods must be unused, in their original packaging, and in saleable condition.

The Seller will refund the purchase amount within 14 days after being notified of the withdrawal, but may withhold the refund until the returned goods are received or proof of shipment is provided.


10. Delays and non-delivery

If delivery is delayed, and this is not due to the Purchaser, the Purchaser may:

  • withhold payment,

  • demand delivery,

  • or cancel the purchase if the delay is significant.

If the purchase is cancelled, all amounts paid will be refunded. Claims must be made in writing.


11. Defective goods

If a product is defective, the Purchaser must notify the Seller within a reasonable time after discovering the defect, and no later than two years after receiving the goods.

The Purchaser may demand:

  • repair,

  • replacement,

  • price reduction,

  • or cancellation of the purchase if the defect is substantial.

12. Seller’s Rights in Case of Purchaser’s Breach

If the Purchaser fails to pay or otherwise breaches the agreement, the Seller may withhold the goods, demand payment, or cancel the contract. Interest may be charged on late payments in accordance with the Act Relating to Interest on Overdue Payments, and uncollected orders may be subject to a handling fee covering actual costs.


13. Warranties

Any warranties offered by the Seller or manufacturer provide rights in addition to those under mandatory consumer law.


14. Personal data

Personal data is processed in accordance with Heymat’s Privacy Policy, available on our Website. Only the data necessary to fulfill your order will be collected and shared with relevant partners such as logistics providers and payment processors.

For the purpose of processing payments, certain personal data (such as payment method, transaction details, and verification information) will be securely transmitted to our payment provider Adyen N.V. Adyen processes this data solely to complete the payment and to comply with applicable regulatory requirements.


15. Dispute Resolution

Disputes arising under these Terms shall be governed by Norwegian law.

The parties shall attempt to resolve any dispute amicably. If resolution cannot be reached, the case shall be brought before Norwegian courts.
